Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the TutDub website, web application, application programming interface (API), and related services (collectively, the "Service"). The Service translates and dubs video/audio content using automated speech recognition, machine translation, and voice-synthesis technology.

By creating an account, uploading content, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy and Voice Cloning Policy, which are incorporated by reference. If you do not agree, do not use the Service.

We may update these Terms from time to time. Material changes will be announced via the Service or by email at least 30 days before they take effect. If you do not agree to the revised Terms, you must stop using the Service and delete your account before the changes take effect. We may apply changes with shorter notice where required by law, to address security, fraud, or abuse, or where the change is not material (e.g., clarifications, typographical corrections). Continued use after the effective date constitutes acceptance.

2. Definitions

"User", "you" — any individual or entity using the Service.
"Content" — any video, audio, text, image, or other material you submit to or generate through the Service, including source videos/audios and resulting dubbed videos, audio tracks, and transcripts.
"Output" — the dubbed video, audio track, and transcript produced by the Service from your Content.
"Voice Cloning" — the process by which the Service re-synthesizes translated speech in the voice of a speaker present in your uploaded video/audio (see the Voice Cloning Policy).

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Service. If you are under 18, you may not use voice cloning features without parental or legal guardian consent, and you represent that you have obtained such consent. Accounts created on behalf of a company must be authorized by that company.

4. Accounts

You must provide accurate registration information (name, email, password) and keep it up to date.

You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately of any unauthorized use.

Authentication tokens and session data are stored on your device (see Privacy Policy). We are not liable for losses arising from unauthorized access due to compromised credentials on your side.

You may request account deletion by contacting us at support@tutdub.com. Upon processing your request, we will delete your Content as described in the Privacy Policy. We aim to process all deletion requests within 14 business days. Deletion of your account will terminate your access to paid plans and remaining credits without refund.

5. Acceptable Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Upload or process Content that you do not have the right to use, or that infringes any third party's intellectual property, privacy, or personality rights.
Use the Service to clone, impersonate, or synthesize the voice of any person without their informed consent, except where the speaker is yourself or you have obtained the necessary rights (see Voice Cloning Policy).
Create deceptive, defamatory, obscene, hateful, harassing, fraudulent, or illegal material, or material that violates the rights of others.
Generate Output intended to mislead, deceive, or defraud (e.g., disinformation, unauthorized impersonation, "deepfakes" used for harm).
Attempt to reverse-engineer, disrupt, overload, or gain unauthorized access to the Service, its infrastructure, or other users' accounts.
Resell, redistribute, or commercially exploit the Service or its API except under a separately agreed Business/API plan.
Use the Service to build a competing product or to train models that replicate TutDub's functionality.
Use voice cloning for commercial exploitation (including advertising, product endorsements, or paid content) without explicit consent from the voice owner.
Create content that misrepresents a political figure's statements, positions, or endorsements.
Generate voice clones for use in sexually explicit, pornographic, or obscene content.
Clone the voice of a minor without appropriate parental or legal guardian consent.

Additional prohibited uses specific to voice cloning are set out in the Voice Cloning Policy.

We may suspend or terminate accounts that violate this section, and we may report unlawful content to relevant authorities where required by law.

6. Content Rights and Licenses

Your Content. You retain all rights in the Content you upload. By submitting Content, you grant TutDub a limited, worldwide, non-exclusive license to store, process, modify, and adapt your Content solely as necessary to provide the Service to you. Processing includes, but is not limited to: transcription, translation, voice synthesis, audio and video/audio editing, format conversion, and synchronization.

Output. Subject to your compliance with these Terms, you own the Output generated from your Content and may use it for your lawful purposes. We claim no copyright in the Output.

No Training Use. We do not use your Content, voice data, or Output to train, fine-tune, or improve our machine learning models, except as necessary to provide the Service to you. We do not share your Content with third parties for model training purposes.

Feedback. We welcome feedback, suggestions, and ideas to improve TutDub. If you submit any, you agree that we may use them freely to improve the Service without any obligation to you. This does not affect your ownership of your Content or Output.

7. Voice Cloning

Use of voice-cloning features is additionally governed by the Voice Cloning Policy. In summary:

Cloning is performed only from the voice present in the video/audio you upload.
Requires your explicit consent and a rights confirmation at upload.
Must not be used to impersonate third parties without authorization.
No persistent voice models or biometric profiles are retained.

By using voice cloning features, you additionally agree that:

You have obtained informed consent from each identifiable individual whose voice is cloned.
You will not clone the voice of any person without their explicit permission.
You are responsible for all Output and its use, including any required disclosures to your audience.

8. Plans, Credits, and Payments

The Service is offered under various plans (including a free tier and paid tiers) and a credit-based system. Details of available plans, pricing, and credit packages are described on our Pricing page at https://tutdub.com/en/pricing and may be updated from time to time.

Credit balances are derived from your transaction ledger and may expire as described at the time of purchase or on the Pricing page.

Paid plans and credit packs are processed by our payment provider(s).

Subscription / Refund Policy:

Cancellation. You may cancel your subscription at any time via your account settings or through the payment provider's manage link. Cancellation takes effect at the end of your current billing period. No refunds are issued for partial billing periods.
Refunds. We offer a 7-day money-back guarantee for first-time paid plan subscribers. If you are not satisfied, contact us within 7 days of your first payment for a full refund.
Credits. Purchased credits are non-refundable and expire as stated on our Pricing page or at the time of purchase. Free credits (including those earned through promotions) expire as stated in the applicable offer or on our Pricing page.
Price Changes. We reserve the right to change plan features, credit pricing, and limits upon 30 days' notice. Changes will not affect your current billing period.

9. Service Availability and Limitations

The Service processes jobs asynchronously; estimated times are not guaranteed. We do not guarantee specific processing speeds or completion times. Queues may be subject to capacity limits.

Output quality depends on the input (audio clarity, language, accents, background noise, video motion). The Service uses automated models and may produce errors in transcription, translation, or voice synthesis. You are responsible for reviewing Output before publication or reliance.

We do not guarantee uninterrupted or error-free operation and may perform maintenance that temporarily limits access.

Processing of source videos/audios and generated files is subject to an automatic retention window (currently 96 hours after the last processing job for that video/audio completes) after which files are deleted from storage (see Privacy Policy).

We reserve the right to refuse, suspend, or terminate processing and accounts that violate these Terms, engage in prohibited uses, or create legal risk for TutDub. We may report unlawful content to relevant authorities where required by law.

10. Intellectual Property

The Service, including its software, models, design, and documentation, is owned by TutDub or its licensors and protected by applicable law. No rights are granted except as expressly stated.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUT IS ACCURATE, COMPLETE, LAWFUL, OR UNINTERRUPTED. Automated transcription, translation, and voice synthesis may contain mistakes.

Voice cloning outputs are generated by automated AI models and may not be perfect replicas. We do not warrant that the cloned voice will be identical to the original speaker, that translations will be error-free, or that the Output will be suitable for any particular purpose. You are solely responsible for reviewing and verifying all Output before publication or use.

12. Limitation of Liability

To the maximum extent permitted by law, TutDub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our aggregate liability shall not exceed the amount you paid us in the twelve (12) months preceding the event.

This limitation does not apply to liability that cannot be excluded by law (e.g., for gross negligence, fraud, death, or personal injury).

Voice Cloning Exclusion. We are not liable for any claims, damages, or losses arising from your misuse of voice cloning features, including unauthorized impersonation, infringement of third-party rights, or failure to obtain required consents.

Nothing excludes liability that cannot be excluded by law.

13. Indemnification

You agree to indemnify and hold TutDub and its officers, employees, and affiliates harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising from:

Your Content and its use of voice cloning
Your failure to obtain required consents for voice cloning
Your violation of these Terms or the Voice Cloning Policy
Your infringement of any third-party rights (including personality, privacy, copyright, and publicity rights)

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for violation of these Terms, non-payment, or prolonged inactivity, with or without notice where lawful. Sections that by nature should survive will survive termination (including IP, disclaimers, liability, and indemnification).

15. Data Protection

Processing of personal data is described in the Privacy Policy and Voice Cloning Policy. By using the Service you acknowledge such processing as described therein.

You acknowledge that voice recordings used for cloning may be considered biometric or special-category data under certain laws. By using voice cloning features, you consent to the processing of voice data as described in the Privacy Policy and Voice Cloning Policy, including the creation of a temporary reference voice sample for the sole purpose of generating your Output. No persistent voiceprint or biometric profile is retained.

16. Third-Party Services

The Service integrates third-party infrastructure and service providers to operate, including providers for storage, compute, email delivery, and payment processing. Your use of these third-party services is subject to their respective terms and privacy policies.

We are not responsible for the availability, security, or performance of third-party services, and we do not control their terms or privacy practices.

17. Governing Law and Disputes

These Terms are governed by the laws of the Russian Federation. Disputes relating to data processing are additionally governed by the Privacy Policy.

Disputes shall be resolved by the courts at the location of ImStocker LLC.

For consumers outside the Russian Federation, nothing in these Terms affects your mandatory statutory rights under applicable law.
